These Terms of Service apply to commission requests, commissioned artwork, collaboration inquiries, and related creative services provided by Lilxth. By submitting a request, making a payment, or using my services, you agree to these Terms.

1. About Lilxth

Lilxth is an independent digital artist offering custom digital artwork and related creative services on an occasional basis.

2. Eligibility

You must be at least 18 years old to order directly. If you are under 18, you may only order with permission and involvement from a parent or legal guardian.

3. Requests and Acceptance

Submitting a commission or collaboration request does not guarantee acceptance. I review each request first and may decline for any reason, including schedule, complexity, subject matter, unclear information, or personal comfort.

A commission is accepted only after I confirm that I can take it, we agree on the scope, final price, estimated timeline, and payment method.

4. Commission Information

To start properly, you should provide a clear idea description, reference images, character or design information, and any important details such as pose, outfit, colors, mood, style, deadline, or usage purpose.

5. Payment Methods and Prices

Payment is required upfront before I start drawing. Current accepted payment methods are credit card, debit card, PayPal, Apple Pay, Steam Digital Gift Card, and Robux. Payment availability may vary depending on the project, platform, or situation.

After your commission is accepted and the final price is confirmed, I will send you a payment page with the available payment methods. Please complete the payment only through the payment page I provide.

Payment pages may include method-specific notices or confirmation popups before redirecting to third-party payment platforms. Please read them before continuing.

Once payment is completed through the agreed method, I will confirm the payment and commission details by email.

Some payment platforms may also send their own payment confirmation, receipt, gift notification, or transaction record.

Third-party payment platforms, such as PayPal, Steam, Apple Pay, Roblox, or card processors, may apply their own checkout rules, processing times, privacy terms, limits, fees, or availability conditions.

Robux payments are completed through Roblox-supported methods, usually through an Experience Pass/Gamepass payment page provided after the commission is accepted and the final price is confirmed. Clients must only purchase the pass that matches their accepted commission quote. Robux payment is considered completed once the correct Roblox transaction is visible and confirmed.

Robux payments are subject to the Robux Payment Disclaimer shown on my website, including the current value limit, Roblox marketplace/transaction fee, and pending Robux processing.

Prices may change over time. The final quoted price for your specific commission will be confirmed before payment.

6. Additional Fees

Additional fees exist to fairly compensate the extra effort, complexity, or urgency involved in a commission.

• Deadline fee: +30% for rush orders that must be completed within a short timeframe, disrupting normal workflow and requiring prioritized scheduling.
• Extra character: +50% for each additional full character or subject added to the artwork.
• Extra emote / design element: quoted depending on complexity.

Each additional subject, whether a full character, emote, or design element, requires creating a separate figure or composition with its own proportions, expression, and interaction within the piece. This significantly increases the overall work and time required, hence the additional charge.

7. Revision Fees

Tiny changes are free within reason.

• Examples: color tweaks, tiny detail changes, small corrections, simple accessory edits, or minor design adjustments.

Moderate revisions may add a small fee depending on complexity.

• Examples: noticeable design edits, texture additions, or moderate layout adjustments.

Major revisions may require an additional fee or a requote.

• Examples: changing the pose, redrawing large parts of the character, changing the background, reworking the composition, or redesigning the artwork after approval.

All additional revision costs will be discussed before being applied. Requests that heavily change the original approved idea may be treated as a new commission or requoted.

8. Timeline and Communication

My usual turnaround is 1 to 4 weeks, depending on complexity, queue, and availability. This is an estimate, not a guaranteed deadline unless specifically agreed.

I usually respond within 24–48 hours. Response time may be longer during busy periods, weekends, holidays, illness, emergencies, or personal obligations.

Final artwork is normally delivered by email to preserve image quality.

9. Refunds and Cancellations

Refunds are generally not available once I have started working, because time and effort have already been invested.

The main exception is if I am unable to complete the commission due to serious unforeseen circumstances on my side. In that case, you will receive a refund for the unfinished work.

If I cancel before starting, paid amounts for that commission will be refunded. If you stop responding, fail to provide required information, or change the scope too heavily, I may pause or cancel the project. Any refund then depends on how much work has already been completed.

Nothing in these Terms limits mandatory consumer rights that may apply by law.

10. Content I Do Not Accept

I do not create NSFW, fetish, illegal, hateful, exploitative, or otherwise inappropriate content. I reserve the right to refuse any subject matter I am not comfortable drawing.

11. Client Conduct

You agree to communicate respectfully, provide necessary information, and not pressure me for unpaid extra work. Harassment, manipulation, abusive behavior, or violation of these Terms may result in refusal, cancellation, or refusal of future service.

12. Copyright and Usage Rights

Unless otherwise agreed in writing, I retain copyright and ownership of the artwork I create. Buying a commission does not transfer full copyright ownership.

By default, you receive a personal-use license. You may post the artwork on social media, use it for personal profiles, banners, wallpapers, or similar personal display, as long as you credit me as Lilxth.

13. Restrictions

Without my written permission, you may not resell, redistribute, sublicense, commercially exploit, trace, heavily edit, repaint, remove my watermark/signature, claim the art as your own, mint it as an NFT, or use it for AI training, machine learning, or generative AI workflows.

You may crop or resize the artwork for formatting, but you may not alter the artwork itself without permission.

14. Commercial Use

Commercial use applies if the commissioned artwork is intended for commercial purposes, such as monetized content, branding, streaming, promotion, merchandise, or other profit-related use.

Commercial use fee: +50%

Commercial usage rights require an extended license. This includes additional permission to use the artwork for promotional, branded, monetized, or business-related purposes.

Logo commissions generally include basic commercial use unless otherwise discussed.

15. Portfolio and Posting

I may post commissioned work online or include it in my portfolio unless you ask me not to. Public posts may include a watermark. If you want your commission private, tell me clearly before or during the order process.

16. Collaborations

Collaboration, product review, and business inquiries are reviewed individually. Unless separately agreed, collaborations require respectful communication, clear boundaries, open discussion if expectations shift, and mutual credit in public final posts where appropriate.

17. Liability

To the fullest extent allowed by law, I am not responsible for indirect, incidental, or consequential losses connected to my services or artwork. If liability applies, it is limited to the amount paid for the specific commission, unless law requires otherwise.

18. Updates and Contact

I may update these Terms when my services, prices, workflow, or legal needs change. The version published on my website at the time of your request normally applies.

This Privacy Policy explains how Lilxth collects, uses, and protects personal data when you visit my website, submit a form, contact me, request a commission, use a payment page I provide, or send a collaboration/business inquiry.

Depending on how you contact me, I may collect:

• name, nickname, username, email address, Discord handle, social media handle, or similar contact details;
• commission or collaboration details, including descriptions, references, character information, images, files, deadlines, style preferences, and usage needs;
• messages sent through forms, email, Discord, or other communication routes;
• payment-related information needed to confirm payment, such as payment method, proof of payment, payment confirmation details, payment page details, payer name, email address, payment status, amount paid, customer note/order details, platform usernames, gift notification details, Roblox Experience Pass/Gamepass transaction records, or partial transaction references;
• timezone, country, communication preferences, or privacy/posting preferences where relevant;
• technical data processed by third-party services, such as IP address, browser/device data, logs, cookies, timestamps, and usage data.

I do not ask for or store full card numbers, card security codes, passwords, full payment credentials, or unnecessary billing details. For PayPal digital commission payments, shipping address collection is turned off where available. PayPal may still process billing or payment verification details under its own checkout and privacy rules.

3. How Data Is Collected

Data is collected when you voluntarily submit it through forms, email, Discord, commission requests, collaboration inquiries, reference uploads, payment pages, payment confirmation, or other communication related to my services.

Some technical data may also be processed automatically by the platforms used to host the website, collect forms, manage communication, provide payment pages, or process payments.

4. Why I Use Data

I use personal data only as reasonably needed to:

• answer inquiries and review requests;
• confirm commission scope, price, payment method, and timeline;
• provide the correct payment page after a commission is accepted;
• create and deliver commissioned artwork;
• communicate about updates, changes, revisions, delays, or delivery;
• process or confirm payments and keep necessary records;
• manage collaboration or business inquiries;
• protect my services, enforce my Terms, prevent misuse, and resolve disputes;
• honor privacy or posting preferences for commissioned work;
• comply with legal, tax, accounting, or recordkeeping obligations.

5. Legal Bases

Where GDPR applies, I rely on these legal bases: contract or pre-contract steps for commissions and inquiries; legal obligation for records, tax, accounting, or compliance; legitimate interest for communication, service protection, portfolio management, and dispute prevention; and consent where a specific processing activity requires it.

6. Third-Party Services

My website and workflow may involve third-party services, including Carrd for website hosting, Tally for forms, Google/Gmail for email, Discord for communication or tickets, and payment providers or platforms such as credit card/debit card processors, PayPal, Apple Pay, Steam, or Roblox/Robux where agreed.

Robux payments may involve Roblox-supported methods such as Experience Passes/Gamepasses connected to a Roblox experience. These providers process data under their own privacy policies and terms. I do not control their independent data practices.

For PayPal payments, PayPal may show me transaction information needed to confirm the payment, such as payer name, email address, amount paid, payment status, and any customer note/order details entered by the payer. My PayPal digital commission payment setup does not require shipping, and shipping address collection is turned off where available. PayPal processes payment, billing, security, fraud-prevention, cookie, and checkout data under its own privacy policy and terms.

7. Data Sharing

I do not sell personal data. I only share or disclose data when necessary for website hosting, forms, communication, payments, legal compliance, accounting, tax obligations, service protection, or legal claims.

I do not use your personal data for third-party advertising, data brokerage, or unrelated marketing.

8. International Processing

Some third-party services may process data outside Croatia, the EU, or the EEA, depending on the provider and the service used. Those providers handle transfers according to their own privacy frameworks, safeguards, and legal obligations.

9. Data Retention

I keep personal data only for as long as reasonably needed. Inquiry data is kept long enough to answer and close the request. Commission and collaboration records may be kept while the project is active and for a reasonable time afterward for delivery, support, disputes, or records.

Payment confirmation records may be kept as long as reasonably needed for order records, support, disputes, or any legal, tax, accounting, or recordkeeping obligations that may apply. Privacy or posting preferences may be kept as long as needed to respect them.

When data is no longer needed and I am not legally required to keep it, I aim to delete or anonymize it.

10. Your Rights

If GDPR applies, you may have the right to request access, correction, deletion, restriction, objection, data portability, or withdrawal of consent where consent is used.

You may also lodge a complaint with your data protection authority. In Croatia, this is the Croatian Personal Data Protection Agency, also known as AZOP.

11. Cookies

My website is hosted through Carrd and may use cookies, logs, or similar technologies for hosting, security, functionality, or performance. Embedded or linked third-party services such as Tally, Google, Discord, PayPal, Apple Pay, Steam, or Roblox may also use their own cookies or similar tools. PayPal checkout pages may use cookies or similar technologies for payment processing, checkout functionality, security, fraud prevention, risk checks, analytics, and account/login detection.

I do not intentionally use my website for behavioral advertising, profiling, or ad tracking. I do not use automated decision-making or profiling to accept, reject, price, or manage commissions.

12. Artwork Privacy

If you ask for your commission to remain private, I may keep a note of that preference so I can respect it. Please communicate privacy requests clearly during the order process.

13. Minors

My services are not directed at young children. If you are under 18, you should only submit commission or project information with permission from a parent or legal guardian.

Please do not send unnecessary sensitive data, passwords, government IDs, full payment details, or private information that is not needed for the project.

14. Security

I take reasonable steps to protect information by limiting what I collect and using established platforms for hosting, forms, communication, and payment handling. However, no online service can guarantee absolute security.

15. Updates and Contact

This Privacy Policy may be updated if my website, tools, workflow, or legal obligations change. The current version will be available on my website.
